Welcome to Basic Builder!

These Terms of Service ("Terms") govern your use of Basic Builder's services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Services.

1. Definitions

• Service(s): The website building, hosting, and management services provided by Basic Builder LLC ("Basic Builder"), including any updates, features, and support services.


• User(s): Individuals or entities who use our Services.


• Account: The account created by the User to access the Services.


• Content: Any data, information, or material uploaded, created, or shared by Users through the Services.

2. Account Registration

• Eligibility: You must be at least 18 years old and have the legal capacity to enter into these Terms.


• Account Information: You agree to provide accurate and complete information when creating an account and to keep this information up to date.


• Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

3. Use of Services

• License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Services in accordance with these Terms.


• Prohibited Activities: You agree not to:
  
  
  • Use the Services for any illegal or unauthorized purpose.
  
  
  • Interfere with or disrupt the Services or servers connected to the Services.
  
  
  • Upload or transmit any malicious code or harmful content.
  
  
  • Attempt to gain unauthorized access to any part of the Services.
  
  
  • Use the Services for websites of an illegal nature or that violate applicable laws and regulations.
  
  
  • Use the Services for businesses outside the scope of small to medium-sized enterprises.
  
  
  
  

4. Content

• User Content: You retain ownership of any Content you upload or create through the Services. By uploading Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your Content for the purpose of operating and improving the Services.


• Responsibility: You are solely responsible for the Content you upload or create and for ensuring that it complies with all applicable laws and regulations.

5. Payment and Subscription

• Fees: The Services are provided on a subscription basis with the following pricing tiers:
  
  
  • Basic Plan:$119/month + $99 one-time setup fee
  
  
  • Growth Plan:$249/month + $199 one-time setup fee
  
  
  • Custom Plan:$399/month + $2500 one-time setup fee
  
  
  
  


• Billing: We bill monthly. One-time fees are charged in full upon activation. You authorize us to charge your payment method for the Services.


• Cancellation: You may cancel your subscription at any time. Your subscription will remain active until the end of the current billing period. There are no pro-rated refunds for partial months.


• Domain and Email Services: We act as a reseller for domains and professional email services. Clients will be billed directly via our reseller platform for these services, with the billing cycle and method they choose, separate from their Site Plan subscription.

6. Service Specifics

• Fully-Managed Service: All updates and changes are included as long as the subscription is active.


• Usage Limitations:
  
  
  • Basic Plan: Includes 1 hour of updates per month.
  
  
  • Growth Plan: Includes 2 hours of updates per month.
  
  
  • Custom Plan: Includes 5 hours of updates per month.
  
  
  • Additional Requests:$50/hour for additional requests above the included quota, with a maximum of 10 additional hours per month.
  
  
  
  


• Ownership and Rental: Websites are rented from Basic Builder, and ownership lies with Basic Builder. After three years on an active subscription, you own the site including HTML, CSS, and content. At this point, you are free to request an export to self-host on your own servers, or you can continue your subscription to continue receiving our fully managed service. At three years, you are also eligible for a free site redesign inline with our updated designs, but if you opt for a redesign, we will retain ownership of the new site for a new three-year period.

7. Support and Maintenance

• Support: We offer support via email, phone, and video call.


• Maintenance: There are no scheduled maintenance periods. Uptime is monitored 24/7 and issues are addressed as soon as possible.

8. Data Protection and Privacy

• User Data: We collect business information, contact details, images, text, and billing information to provide our Services. Users' websites may collect leads via contact forms.


• Compliance: We comply with GDPR, CCPA, and POPIA regulations. For detailed information on how we handle your data, please refer to our Privacy Policy.

9. Termination

• By You: You may terminate your account at any time by contacting us at info@basicbuilder.co.


• By Us: We may suspend or terminate your access to the Services if you violate these Terms or for any other reason at our sole discretion.


• Effect: Upon termination, your right to use the Services will immediately cease. We may delete your Content upon termination.

10. Disclaimer of Warranties

The Services are provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Services, including but not limited to the accuracy, reliability, or availability of the Services.

11. Limitation of Liability

To the fullest extent permitted by law, Basic Builder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Services.


• Any unauthorized access to or use of our servers and/or any personal information stored therein.


• Any interruption or cessation of transmission to or from the Services.

12. Indemnification

You agree to indemnify, defend, and hold harmless Basic Builder, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

13. Changes to Terms

We may revise these Terms from time to time. If we make material changes, we will provide you with notice. By continuing to use the Services after changes become effective, you agree to be bound by the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law principles.
